Questions about non-resident tax
Yes, if you have Portuguese-source income, such as rental income from Portuguese property, dividends from Portuguese companies or pensions from Portuguese public sources, you are required to file an IRS return in Portugal as a non-resident.
The withholding rate for non-residents is generally 28%, but this may be reduced by a Double Taxation Convention (DTC) with your country of residence.
The NHR (Non-Habitual Resident) regime, created in 2009, offered a 20% IRS rate on qualifying employment income and exemption on many foreign-source incomes. This regime was closed to new applicants in 2024.
The IFICI (Scientific Research and Innovation Tax Incentive), created in 2024, is the NHR successor. It applies a 20% rate on income from certain qualified categories with specific eligibility conditions. We assess each case individually to determine eligibility and the best strategy.
Yes. Through a power of attorney, we act as your representative and obtain the NIF from the Tax Authority on your behalf. The process typically takes between 5 and 10 business days.
For non-EU citizens, appointing a fiscal representative resident in Portugal is also mandatory, a role we take on alongside the NIF application.
Rental income from Portuguese property is taxed at 28% for non-residents on the gross rental amount. There are no expense deductions available under the standard non-resident rate.
Depending on the DTC with your country of residence, there may be a tax credit or exemption in your home country. We analyse the specific situation and optimise within the applicable law.
The IRS filing deadline for non-residents is the same as for residents: 1 April to 30 June of the year following the tax year.
We recommend starting the process in March to allow sufficient time to collect all necessary documentation.
